衡平法/Equity
衡平法是源自英格兰两种法律体系之一，另一种则为普通法。
起源
衡平法缘起于古代英国，当时大部份法院均以普通法审理案件。由于普通法十分注重程序正义，很多人仅仅是因为未能符合程序，例如过了期限起诉，而得不到公正对待。于是大不列颠大法官设立一法院，以较为宽松的态度处理案件，这就是衡平法的来源。
比较
和普通法比较，衡平法较为着重事实公正， 较少拘泥于形式。以前，普通法和衡平法的案件必须由不同法庭处理。同一件案件，普通法上败诉后，原告人就可以将案件申请用衡平法由衡平法的法庭审理。为解 决不便问题，英国通过Judicature Acts 1873-1875，合并普通法和衡平法的法庭，同一法庭可同时应用普通法和衡平法。
衡平法凌驾普通法，两者有矛盾时以衡平法为准。
